A.     Approval of a variance to allow the applicant to have an 8’ X 10’ utility building to remain at 4 feet from the rear property line.

Section 153.097 (B) (4) requires accessory structures to be 5 feet minimum from the side and rear lot lines.  “…All other structures or uses shall be located….they may be located in a rear yard but must be not less than five feet from any rear or side lot lines.”
