A.     Approval to allow the owner of 11580 Princeton Pike to a construct a retail building and associated parking with the following variances:

 

1.      To construct the building 39 feet from the right of way on Princeton Pike.  Said variance is from Section 153.220 “The minimum front yard setback…shall be 50 feet.”

2.      To construct parking 5 feet from the right of way on East Kemper Road.  Said variance is from Section 153.502(C) “In no case however, shall the parking area or access drives be located closer than 10 feet from any right of way…”

3.      To construct 60 degrees parking with a stall dimension perpendicular to the curb at approximately 17 feet.  Said variance is from Section 153.502(A) which shows a minimum parking space dimension perpendicular to the curb at 20’11” from the curb.

4.      To construct the suite with an impervious surface ratio of 0.78.  Said variance is from Section 153.224 “No use in the GB district shall exceed on impervious surface ration of 0.75.”

5.      To construct the site without the required loading space.  Said variance is from Section 153.511(A) “All retail stores under 20,000 square feet in gross floor area shall have at least one loading facility space.”

B.     Approval of a variance to allow the owner of the property at 595 West Kemper Road to erect a fence within the setback from the side street of a corner lot.  Said variance is from Section 153.482 (A)(3) “Fences on corner lots shall not be located in the required setback for the building from the side street line.”

C.    Approval of a variance to allow the owner of 232 Harter Avenue to place a utility building 2 feet from the rear lot and 2’ – 3” from the side lot line.  Said variance is from Section 153.097 (B)(4) “All other structures…must be not less than 5 feet from any rear or side lot lines.”
